Melissa, the burden of proof for the debt falls onto the shoulders of the collector. If you are attempting to find out who owns the debt now in an attempt to pay it off, contact the original creditor or try reviewing a copy of your credit report. The collection account may be listed there and you can use this information to contact the legitimate collector.

I had a Clout Visa many years ago also. I recently was contacted by an irreputable agency trying to collect on the card. I asked for proof of my debt or their client's information if they were not able to provide me with proof so I could research it myself. I know the card went to collections and I've never heard anything from anyone since I tried to consolidate my debt about 3 to 4 years ago. I called this Bank of America number on here and they were not able to locate any account info for me whatsoever...what is the next step, call them back and ask to talk to a manager or a fraud investigator? I really need to know if I still have a debt out there and who it was sold to.

Bank of America may not have records of your card if it has not been active for the past 6 years, but they should be able to find a way to get the information to you. When you contact Bank of America, if you experience bad customer service, ask to speak to a manager and explain your situation. Good luck.

I had a Clout Visa card 6 yrs ago. I tried to contact Bank of America to ask them questions about it, and I not only got horrible customer service but they did not know what I was talking about. What could be the next step?

Bank of America purchased Clout Visa, so you should contact Bank of America customer service at 1-800-789-6685. They will get you in touch with a fraud investigator.

Recently my fiance has received phone calls from people threatening him with court action over a clout credit card that he never took out. His identity was stolen and someone ran up a credit card bill and never paid it. This is from 5 years ago and it is the first time he has ever been contacted at all. No bills, no calls, no e-mails nothing. How do we resolve this?

I am a victim of identity theft and I trying to contest this before a wage garnishment goes through. I need some one from Clout Financial Services to contact me as soon as possible because they were the ones that messed up when they allowed some one to open a credit card in my name.

Mike,

A card issuer does not have to inform you when they sell your account to another issuer. You do need to be informed by the new card issuer if the sale makes any changes in your account. For help on working with a collection agency I suggest that you read the article Dealing with Collection Agencies here on LoveToKnow. It will show you your rights and give you tips on how to proceed. Also, be sure to get everything in writing.

I called about my account. I understand Clout sold it to Bank of America which then sold it to M & I Bank which sold it to Eastern Asset Management. No one sent me a letter of the changes and now almost 5 yrs later a collection Agency calls me threatening to sue me. If I had known about any balance I would have gladly payed it. I also was called in 2007 regarding this account. They claimed to have settled on $683.00 but took my money and sold the account to someone else, now they are calling threatening me. Now I have to pay again, but with better precautions because they never sent me a letter. I offered monthly installments so that i can pay the balance, but they are not willing to accept. I can't afford a judgment and I can't afford to pay what they are asking in full.

You mentioned in your earlier comment that you have received a collection letter. Your account number should be on that collection letter. If you have any questions about the account number, you should call the telephone number provided on the collection letter. If there is no telephone number on the letter, be sure and send a registered letter to the address on the collection letter.

and another thing, I dont even know my account number to send the payments how do i go about getting that?

does anyone know the address that they have now so i can send in the payments, its been 3 years and they are just now asking for payments and threatening me with court action.

If you have not made payments on your Clout card since 2005, I am sure that your credit score has suffered. You should contact Clout and explain that you are in the military and stationed overseas. They will work with you to set up a payment plan.

i have an outstanding debt i owe clout and i want to know if u could help me start making the neccessary payments i need to make on the card im in the airforce and im stationed overseas. it hard for me to keep up with this because of the time difference. i havent made a payment since 2005.
